Notice Regarding Texas v United States

The MIRA is not surprised by the Temporary Injunction ruling by  Judge Andrew Hanen in the U.S. District Court in Brownsville, Texas yesterday against the implementation of the Obama Administrationsexecutive actions on prosecutorial discretion, but we STRONGLY disagree with that ruling. We  believe that the Texas judge made the wrong call and we are confident that the Executive Actions for expanded Deferred Action for Childhood Arrivals (IF) and for Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) WILL be UPHELD and IMPLEMENTED soon.  The Department of Justice will appeal that temporary injunction and may request a stay of the injunction throughout the appeals process.  In the meantime, the Department of Homeland Security (DHS) will NOT begin accepting requests for the expansion of DACA tomorrow, 二月 18, as originally planned. Until further notice, the DHS is also suspending the plan to accept requests for DAPA. We are confident that the federal government will ultimately prevail.

 

We do not know how long the appeals process will take, but we recommend that individuals who are potentially eligible for expanded DACA or DAPA continue to prepare to apply.  These individuals should gather the necessary documentation and seek qualified counsel to give themselves the best chance of success.  Potential applicants must also be wary ofnotarioswho offer legal advice without a license that is unethical and fraudulent.  It is also important to note that those who were ALREADY granted DACA are in NO WAY AFFECTED by this ruling so they should apply for the their DACA renewal as planned.  This Texas ruling only delays the expansion of DACA and delays the start of DAPA.

 

We urge potential expanded DACA and DAPA applicants and their families not to be fearful.  The MIRA and other immigrants rights groups nationwide will continue to advocate for expanded DACA and DAPA.  Mississippi is one of the 25 other states that supported Texas in filing for  the injunction.  Mississippi residents should contact Governor Phil Bryant to tell him how disappointed they are in this turn of events.  Send a message to the governor at http://www.governorbryant.com/contact/
