Law against encouraging illegal immigration could violate First Amendment

A federal law that makes it a crime to encourage or induce foreigners to enter or stay in the U.S. illegally may run afoul of the First Amendment, a federal appeals court suggested in an unusual order Monday.
A 9th U.S. Circuit Court of Appeals panel asked federal public defenders and immigrant rights groups to submit amicus briefs arguing that a San Jose, Калифорния, woman was improperly convicted because the law is vague or overbroad.

Representatives of Immigration and Customs Enforcement say that the arrests of undocumented immigrants last week by plainclothes officers who did not identify themselves to bystanders outside a Brooklyn courthouse were allowed under current policy.
Under the Trump Administration, arrests at courthouses have become a common occurrence, much to the chagrin of immigration attorneys and immigrant rights advocates.

The Trump administration’s latest attempt to punish sanctuary cities hit a snag on Friday when a federal court ruled the Justice Department cannot withhold public safety grants from jurisdictions that refuse to assist federal immigration authorities. Attorney General Jeff Sessions had attempted to prevent cities and states from receiving these funds unless they cooperatedwith immigration officials’ crackdown on undocumented immigrants. The court held that Sessions in fact has no power to attach new restrictions to the grants, rendering most of his new rules unlawful.

Venture capitalists are suing the Trump administration for delaying an immigration program

In a new lawsuit, a group of venture capitalists says the Trump administration erred by delaying a program meant to help entrepreneurs from other countries start businesses in the United States.
The International Entrepreneur Rule, created under the Obama administration, was designed to give foreign-born startup founders a way to remain in the US while they build businesses, but this year, the Department of Homeland Security blocked the rule, just before it was set to go into effect in July.
